Facilitating Competition Through Effective Adjudication and Enforcement

On July 16, 2009, the Fair Trading Commission (FTC) hosted a Symposium that focused on the optimal legal structure that will ensure procedurally sound adjudication of anti-competitive conduct.

Following Opening Remarks from Mr. David Miller, Executive Director, Miss Wendy Duncan, Legal Officer, provided a background and overview of the relevant issues.

The three discussants, Dr. Derrick McKoy, Chairman of the FTC, Dr. Peter-John Gordon, Commissioner of the FTC and Mr. B. St. Michael Hylton, O.J., Q.C, former Solicitor General of Jamaica, examined the three adjudicative bodies that have been considered, namely the Court; a specialized independent Tribunal; and the Commissioners, sitting as a quasi-judicial body.

The Symposium was moderated by Mrs. Barbara Lee, Executive Director of the CARICOM Competition Commission.
